AMTRUST REALTY MAX – SALES/BROKER ASSOCIATE AGREEMENT & TERMS OF SERVICE

By completing this payment, I acknowledge and agree:

  • My Florida real estate license is currently inactive and will be placed active under AmTrust Realty Max, a non-MLS referral-only brokerage.
  • I understand most brokers require MLS membership, but AmTrust Realty Max does NOT require MLS or Realtor® association membership.
  • I will become a referral-only agent and cannot actively engage in real estate brokerage activities (no showings, contracts, negotiations, representation, or other brokerage activities, etc.).
  • I may legally earn referral fees (standard is 25%).
  • I may refer clients to any licensed MLS agent or broker, who must sign a referral agreement with AmTrust Realty Max.
  • The cooperating broker pays AmTrust Realty Max the referral fee, and I receive 100% of that fee (no splits, no transaction fees).
  • I understand there is no guaranteed income, and payment is only made after a successful closing and receipt of funds from the cooperating broker to AmTrust Realty Max.
  • I agree to pay a $60 joining/administration fee for any period of time up to one year, which automatically renews annually and is non-refundable even if cancelled early.
  • I am an independent contractor, not an employee, and I am responsible for paying all of my own taxes. Broker will pay me as an independent contractor and will provide me with a Form 1099 for tax reporting purposes.
  • I agree not to bypass AmTrust Realty Max to collect referral fees directly.
  • I may market online and on social media and may use the company name and branding as permitted.
  • I agree to comply with all rules of the Florida Real Estate Commission and the Florida Department of Business and Professional Regulation.
  • This Agreement may be cancelled by the Associate at any time by sending an email to the Broker at admin@amtrustrealtymax.com, and the Broker will process the cancellation within three (3) business days. The Broker may terminate this Agreement at any time if the Associate violates the Terms of Service or fails to comply with applicable rules or laws.
  • I agree to the full Terms of Service and Referral Associate Agreement.
